Unlike most debt collection agencies, we are not restricted by rigid systems and debt recovery instructions can be processed to suit the requirements of particular clients. Normally, we only require the identity of the debtor and details of the debt (for example, copy invoices) in order to initiate recovery.
Our clients have the reassurance that recovery of all debts is personally supervised by a solicitor who is also available to deal with any enquiries which they may have. As a result, all debts are processed in the most efficient and appropriate manner. If, as occasionally happens, the debt is disputed, we have full facilities to pursue contested proceedings on our clients' behalf and to progress the matter to the earliest possible conclusion.
Our association with national process servers and enforcement officers means that we can offer a similar standard of service, no matter where in the country the debtor might be located. Once judgment has been entered, we will advise concerning the best method of enforcement according to the circumstances of the debtor. Options include instruction of the county court bailiff (for routine debts), instruction of the High Court Sheriff (for higher value claims), securing the debt by a charge against property, arranging for payments to be deducted directly from the debtor's salary, securing payment direct from the debtor's bank account and arranging for the debtor (or directors of a company) to be required to attend court to provide financial information including details of assets which might be realised to recover payment. In some cases it is appropriate to consider bankruptcy or winding-up proceedings.
our charges
Our flat rate charge for standard debt collection is £30.00 plus VAT per debt claim processed. The fee is payable for each debtor claim regardless of the number of invoices or the total or aggregate value of debts claimed against the particular debtor. If payment is recovered following receipt of instructions then the total charge is £30.00 plus VAT.
If it is necessary to institute court proceedings, there is a court fee payable. The amount payable varies according to the value of the claim. We will normally require advance payment of the fee before instituting proceedings. However, both the fee and fixed solicitors' costs are added to the amount payable by the debtor. Consequently, if the debtor makes payment following institution of proceedings or entry of a default judgment, the net charge is still £30.00 plus VAT. There may be additional charges for enforcement of recovery of the judgment debt.
If the claim is defended then our standard charging rates apply. These are based on the time spent dealing with the matter. However, we will give you the option of deciding whether to proceed before these charges are applied.
